TERMS AND CONDITIONS

By using the website www.frcompression.com , registering in our database, and purchasing products and services from the website www.frcompression.com  , you agree to the terms and conditions below.

DEFINITIONS AND TERMS

The owner of the website www.frcompression.com  is Inedit Partner Concept SRL, with registered office at Calle Pau Casals no 22, Industrial Park Elche, 03203, Alicante, Spain  with serial number in the Spain NIF Register B21832183, telephone number +40 735 224 139, email info@frcompression.com, hereinafter referred to as the Seller.

Website – online store hosted at the web address www.frcompression.com  .

Seller – FR Compression SL

Buyer – can be any natural person over 16 years of age or a legal person or any legal entity that creates an Account on the Site and places an Order.

Customer – can be any natural person over 16 years of age or legal entity who has or obtains access to content, through any means of communication (electronic, telephone, etc.) made available by the Seller or based on an existing user agreement between the Seller and it and which requires the creation and use of an Account.

User – any natural person over 16 years of age or legal entity registered on the Site, who, by completing the Account creation process, has agreed to the site-specific clauses.

Account – the section of the Site consisting of an e-mail address and a password that allows the Buyer to submit the Order and which contains information about the Client/Buyer and the Buyer's history on the Site (Orders, tax invoices, Goods warranties, etc.). The User is responsible for and will ensure that all information entered when creating the Account is correct, complete and up-to-date.

My Cart – section of the Account that allows the Buyer/User to add Goods or Services that he/she wishes to purchase at the time of addition or at a later time; if the Goods or Services are not purchased at the time of addition by placing the Order, the Buyer/User will benefit from the service offered by the Seller to track the Goods and Services by receiving Commercial Communications from him/her.

Order – an electronic document that acts as a form of communication between the Seller and the Buyer through which the Buyer transmits to the Seller, through the Site, his intention to purchase Goods and Services from the Site.

Goods and Services – any product or service listed on the Site, including the products and services mentioned in the Order, to be provided by the Seller to the Buyer.

Contract – represents the distance contract concluded between the Seller and the Buyer, without the simultaneous physical presence of the Seller and the Buyer.

Content – all information on the Site that can be visited, viewed or accessed using an electronic device; emails sent to Buyers by the Seller and any information regarding the Goods and/or Services as well as the rates charged by the Seller, communicated to the Buyer by any means of electronic communication.

Document – these Terms and Conditions.

Transaction – the collection or reimbursement of an amount resulting from the sale of a Good and/or Service by the Seller to the Buyer, by using the services of the card processor approved by the Seller, regardless of the delivery method.

CONTRACTUAL DOCUMENTS

By registering an Order on the Site, the Buyer agrees to the form of communication (telephone or e-mail) through which the Seller conducts its commercial operations.

The notification received by the Buyer after placing the Order is for information purposes only and does not constitute acceptance of the Order. This notification is made electronically (e-mail) or by telephone.

For justified reasons, the Seller reserves the right to change the quantity of the Goods and/or Services in the Order. If it changes the quantity of the Goods and/or Services in the Order, it will notify the Buyer at the e-mail address or phone number provided to the Seller when placing the Order and will return the amount paid.

The contract is considered concluded between the Seller and the Buyer upon receipt by the Buyer from the Seller, via e-mail, of the notification of shipment of the Order.

ONLINE SALES POLICY

Access to place an Order is allowed to any User/Buyer.

For justified reasons, we reserve the right to restrict the User/Buyer's access to place an Order and/or to some of the accepted payment methods, if we consider that based on the User/Buyer's conduct or activity on the Site, his/her actions could harm the Seller in any way. In any of these cases, the User/Buyer may contact the customer relations manager at the email address info@frcompression.com to be informed of the reasons that led to the application of the above-mentioned measures.

Communication with the Seller can be made via the email address and telephone number mentioned above.

All prices for Goods and/or Services presented on the Site are expressed in EUR and include VAT.

In the case of payments by bank transfer, the Seller is not and cannot be held responsible for any additional costs incurred by the Buyer, including but not limited to currency conversion fees applied by the bank.

PLACING ORDERS

The Customer/Buyer can place Orders on the Site by adding the desired Goods and/or Services to the shopping cart, and then finalizing the Order by making the payment through one of the indicated methods. Once added to the shopping cart, a Good and/or a Service is available for purchase to the extent that there is stock available for it. Adding a Good/Service to the shopping cart, in the absence of finalizing the Order, does not entail the registration of an order, nor the automatic reservation of the Good/Service.

By completing the Order, the Buyer agrees that all data provided by him, necessary for the purchase process, are correct, complete and true at the date of placing the Order.

By completing the Order, the Buyer consents that the Seller may contact him/her, by any means available/agreed upon by the Seller, to confirm the order as well as in any situation where it is necessary to contact the Buyer.

The Seller may cancel the Order placed by the Buyer, following prior notice to the Buyer, without any subsequent obligation of either party to the other or without either party being able to claim damages from the other in the following cases:

  • the data provided by the Client/Buyer on the Site are incomplete and/or incorrect;

  • the payment was not made;

  • failure to confirm the order after contacting the Buyer by the Seller, as a result of placing an order on the sites;

  • The product is out of stock.

The Buyer is obliged to check the integrity of the package and to notify the Seller if they are damaged.

At the same time, the Buyer has the right to test and verify the Goods he has purchased to the extent necessary to establish the nature, characteristics and functioning of the Goods.

BILLING – PAYMENT

The price, payment method and payment term are specified in each Order. The Seller will issue an invoice to the Buyer for the Goods and Services delivered, the Buyer's obligation being to provide all the information necessary for issuing the invoice in accordance with the legislation in force.

The buyer can opt for one of the payment methods displayed on the site: bank transfer, card payment, cash on delivery to the courier.

For online card payments we use the payment processor NETOPIA Payments SRL.

The shipping cost is borne by the buyer. Information regarding the shipping cost is displayed on the site's checkout page, after entering the buyer's details.

The Seller will send the Buyer the invoice related to the Order containing Goods and/or Services sold by the Seller.

By sending the Order, the Buyer expresses his/her agreement to be contacted by the Seller to confirm the order and to receive invoices in electronic format via electronic mail, at the email address mentioned in his/her Account.

If this information is unavailable for more than 48 (forty-eight) hours in the Account, please notify us of this issue at the email address info@frcompression.com.

DELIVERY OF GOODS

Delivery of goods is done by express courier.

The shipping time for goods is 2-3 business days from the date the order is placed.

The Seller will deliver the Goods and Services only on the territory of Romania.

The seller is not responsible for any delays in courier services.

GUARANTEES

All Goods sold by the Seller benefit from warranty conditions in accordance with the legislation in force and the commercial policies of the manufacturers. The Goods are new in their original packaging and come from authorized sources.

ORDER CANCELLATION AND RETURN OF PRODUCTS

The Buyer has the right to withdraw from the Contract, respectively to return a Good or to renounce a Service, within 14 calendar days, without invoking any reason and without incurring any costs other than those of delivery. Thus, according to GEO no. 34/2014, the period for returning a Good or renouncing a Service expires within 14 days from the day on which the Buyer takes physical possession of the Good.

If the Buyer decides to withdraw from the Contract, he will send an email to info@frcompression.com together with a copy of the invoice.

Within 5 days from the date of communication of the intention to return, the Buyer must send the products to the address specified by the Seller.

If the Customer/Buyer requests withdrawal from the Contract within the legal withdrawal period, they must also return any gifts that accompanied the respective product.

The Seller will refund the amount within a maximum of 14 (fourteen) days from the date on which the Seller took possession of the returned product. The amount will be refunded to the Buyer's account.

If the Good is returned in a condition in which it can no longer be sold as new (open packaging, missing accessories, the Good is damaged), we reserve the right to request a fee to return the Good to its original condition, as applicable, or to cover the price difference resulting from selling the product as resealed.

Any diminution in the value of the Goods resulting from their handling other than that necessary to determine the nature, qualities and functioning of the Goods is the responsibility of the Buyer. For clarity, from the total price of the returned Goods, the Seller will retain an amount of money representing the diminution in the value of the Goods in the proportion of 5%-100% of the initial value of the Goods, as the case may be. The amount of the diminution fee will be communicated to the Buyer upon receipt of the returned Goods.

If a Good and/or Service ordered by the Buyer cannot be delivered by the Seller, the latter will inform the Customer/Buyer of this fact and will return the value of the Good and/or Service to the Buyer's account, within a maximum period of 7 (seven) days from the date on which the Seller became aware of this fact.

After verifying the account you registered with and the modules completed on the platform, if you meet the above-mentioned conditions, we will refund the full amount within a maximum of 30 days from the date of your request.

Access to study modules is not transferable.

Service contracts will not be reimbursed after the services have been fully provided.

LIABILITY

The Seller cannot be held liable for damages of any kind that the Buyer or any third party may suffer as a result of the Seller's performance of any of its obligations under the Order and for damages resulting from the use of the Goods and Services after delivery and in particular for their loss.

By creating and using the Account, the User/Buyer assumes responsibility for maintaining the confidentiality of the Account data (username and password) and for managing access to the Account, and, to the extent permitted by applicable law, is responsible for the activity carried out through his/her Account.

By creating the Account and/or using the Content and/or placing Orders, the Client / User / Buyer expressly and unequivocally accepts the Terms and Conditions of the Site in the latest updated version that is communicated within the Site, existing on the date of creating the Account and/or using the content and/or on the date of placing the Order.

The Seller reserves the right to periodically update and modify the Site Terms and Conditions to reflect any changes in the manner and conditions of operation of the Site or any changes in legal requirements.

PRIVACY

The Seller will maintain the confidentiality of any information you provide. The disclosure of the information provided will only be possible under the conditions specified in the Personal Data Protection Policy.

No public statement, promotion, press release or any other form of disclosure to third parties will be made by the Buyer/Client regarding the Order/Contract without the prior written consent of the Seller.

COMMERCIAL COMMUNICATIONS

The Buyer/User/Client may at any time change their option regarding the consent given to the Seller for Commercial Communications containing general and thematic information including information regarding offers or promotions, as follows:

  • by accessing the unsubscribe link displayed in emails received from the Seller;

  • by contacting the Seller at info@frcompression.com

 

FORCE MAJEURE

Neither party shall be liable for failure to perform its contractual obligations if such failure to perform on time and/or properly, in whole or in part, is due to a force majeure event. Force majeure is an unforeseeable event, beyond the control of the parties and which cannot be avoided.

If, within 15 (fifteen) days from the date of its occurrence, the respective event does not cease, each party will have the right to notify the other party of the full termination of the contract without either party being able to claim any other damages from the other.

INTELLECTUAL AND INDUSTRIAL PROPERTY LAW

The Content, as defined in the preamble, including but not limited to logos, stylized representations, commercial symbols, static images, dynamic images, text and/or multimedia content presented on the Site, are the exclusive property of the Seller, with all rights obtained in this regard directly or indirectly (through licenses for use and/or publication) reserved to the Seller.

The Customer/Buyer/User is not permitted to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, display, include any Content in any context other than the original one intended by the Seller.

The Customer/Buyer/User may copy, transfer and/or use Content only for personal or non-commercial purposes, only if they do not conflict with the provisions of this document.

APPLICABLE LAW – JURISDICTION

This contract is subject to Romanian law. Any disputes arising between the Seller and Users/Buyers will be resolved amicably or, if this is not possible, the disputes will be resolved by the competent Romanian courts in the Municipality of Bucharest.

FINAL PROVISIONS

By using this site, as well as by creating an account/placing an order, you express your agreement to the Terms and Conditions presented in this document, as well as to the Cookie Policy and the Personal Data Protection Policy .

This document enters into force on January 1, 2025.

We reserve the right to modify our security and data protection measures, as well as our cookie policy and terms and conditions.

In such cases, we will modify/adjust this document accordingly. Therefore, we kindly ask you to follow the current version of the Notice regarding the terms and conditions, data protection and cookie policy, as these may undergo modifications/adjustments.
